Brazilian government inks major airport privatisation contracts

BRAZIL. Brazil’s national civil aviation agency ANAC yesterday signed contracts with the new private managers of the airports representing 30% of total passengers and 65% of international passengers in Brazil: Invepar ACSA at São Paulo Guarulhos, Brazil Airports (Triunfo, UTC and Egis) at Viracopos, and Infrámerica at Brasilia.

In a statement ANAC said that each airport is now to be administered by a Special Purpose Entity (SPE), new companies formed by each consortium in partnership with Infraero (which as a 49% share).

“In the first 30 days, the three airports will be managed by [state airport authority] Infraero. During this period, the concessionaires will submit a Plan of Operational Transfer (PTO) for approval by ANAC,” the statement said

After approval of the PTO, a 180-day assisted operation will begin. Infraero will have management control for the first 90 days alongside the new operator, who then takes over for another 90 days before assuming full control.

The PTO can be extended for a further 180 days if required.

“The goal of the PTO is to promote the transfer of airport activities without interruption, ensuring an effective transition period and safe airport operations,” the statement said.

Attention will now move to the development plans by the three consortia.

Ahead of the 2014 World Cup Infrámerica must build a new terminal at Brasilia (with 2 million passenger capacity), Brazil Airports a 5.5 million capacity terminal at Viracopos, while Invepar-ACSA is to deliver a 7 million capacity terminal at Guarulhos, among other works.

Fines for non-compliance with agreed delivery deadlines will be R$150 million (US$73 million), with a R$1.5 million (US$730,000) penalty for every day of delay.
